Mediation is a process in which two parties agree to resolve their dispute by negotiating over alternative solutions presented by a mediator. In order to construct such solutions, the mediator brings more information and knowledge, and, if possible, resources to the negotiation table. In order to do so, the mediator faces the challenge of determining which information is relevant to the current problem, given a vast database of knowledge. The contribution of this paper is the automated mediation machinery to resolve (...) this issue. We define the concept of a Mediation Problem and show how it can be described in Game Description Language. Furthermore, we present an algorithm that allows the mediator to efficiently determine which information is relevant to the problem and collect this information from the negotiating agents. We show with several experiments that this algorithm is much more efficient than the naive solution that simply takes all available knowledge into account. (shrink)

The whole of Montaigne's work can be read as a great educational proposal: to know oneself better in order to build oneself better and face life better. In this article we will examine a reading from a vital dialectic of education in, The Essays. A dialectic that starts from Montaigne's individual experience, moves through the entire human condition, and returns to the reader willing to be analyzed. From this dialogical perspective, training in judgment is studied as a nodal point in (...) the educational process, in which the teacher plays a fundamental role. In conclusion, a tentative proposal of Montaigne’s curriculum is asserted in which philosophy has a fundamental role, by offering elements to converse with life. (shrink)

En representación de la Colección La Fuente, los autores entrevistan a Cecilia Boal, viuda y colaboradora de Augusto Boal, fundador del teatro y la estética del oprimido. La entrevista permite complementar, con los aspectos menos conocidos de la vida y obra del destacado creador y dramaturgo brasileño, el libro que La Fuente le dedica en su serie Homenaje.

Se muestra y fundamenta una de las principales ideas que desarrolla augusto Boal en su libro Estética del Oprimido: toda actividad artística, para que lo sea realmente, debe cumplir ciertos requerimientos éticos.

El texto sirve como capítulo introductorio y de presentación del libro Teatro y Estética del Oprimido. Homenaje a Augusto Boal. Se reflexiona y evalúa críticamente sobre los diferentes "usos" que se hacen del legado teórico-práctico de Augusto Boal, lo que se hace y lo que, ajuicio de los autores, se debe hacer con él. Se describe además las fuentes y el contenido capitular del libro en cuestión.

Los autores realizan un análisis comparativo entre The Tempest de Willian Shakespeare y La Tempestad de Augusto Boal, siguiendo la pauta de este último autor, quien ve en su obra no la adaptación de la del clásico dramaturgo inglés, sino la respuesta a aquella desde la perspectiva de Caliban y no de Próspero.

Este libro inaugura la serie Homenaje de la Colección La Fuente. Con él se busca reconocer, de manera particular, al pensador, dramaturgo y director brasileño Augusto Boal (1931-2009), creador del teatro y la estética del oprimido, genuina aportación cultural latinoamericana que mucho tiene que ver con ese particular lugar de enunciación que es Nuestra América y sus siempre actuales expectativas emancipadoras. El libro fue precedido y nutrido por un Coloquio que en mayo de 2014 reunió a importantes especialistas y seguidores (...) del legado teórico-práctico de Boal y que tuvo como tema principal el del rescate y la continuación de su obra. Incluye los más importantes trabajos allí presentados, junto a un estudio biográfico, una contribución enviada por su hijo, una entrevista a su esposa y dos obras del propio Boal que (una parcialmente y la otra de manera completa) se publican por primera vez. El objetivo de esta investigación es determinar si existe influencia en los alumnos al elegir una carrera profesional por parte de los padres al manifestar estos un deseo diferido por obtener un título profesional y establecer el grado de satisfacción de los alumnos con su carrera elegida. La investigación se realizó dos etapas, la primera detecta si existe el deseo diferido de los padres por obtener un título profesional y la influencia de este sobre los alumnos. La segunda midió la (...) satisfacción de los alumnos con la carrera y el grado de influencia de los padres. El 79.31% de los padres presentan el deseo diferido por obtener un título profesional, de los cuales el 67% de ellos a influenciado alguno de sus hijos con su deseo, la satisfacción de los alumnos con su carrera está directamente relacionada con la influencia de los padres y con el semestre que cursa. Se concluye que el deseo diferido de los padres por obtener un título profesional existe en la mayoría de ellos y este se refleja en sus consejos para la selección de la carrera por parte del alumno y su grado de satisfacción. La pregunta por el ser humano en Montaigne atraviesa todo el libro de Los ensayos. Una pregunta que se responde Montaigne en su proceso de pintarse y describirse, donde encuentra toda la condición humana. Al ir escribiendo se encuentra con el in-terrogante ¿Qué se yo? Que busca dar respuestas en sus fluctuantes escritos, los cuales reflejan su experiencia de vivir como un humano, orgulloso y miserable, endiosado y humilde, dualizado y unificado, en un ser que es cuerpo y alma en (...) una especie de unión marital. En la primera parte de este artículo, me adentro en lo que significa para Montaigne la comprensión del ser humano desde su condición fluctuante. En una segunda parte, me adentraré en la condición humana desde la experiencia y la humildad que permite a Montaigne desligarse del antropocentrismo. En la tercera parte, desde lo trabajado llegaré a la comprensión de la unidad del hombre en su cuerpo y alma como un matrimonio. Por último, no dejaré de lado el aspecto conversacional en la comprensión antropológica montaniana, que le permite experimentar la pluralidad, la diversidad y la tolerancia. (shrink)

Los avances científico-tecnológicos han abierto una brecha en cuanto a los tratamientos médicos y los valores morales que deben sustentar la atención de salud. El profesional de enfermería no está exento de estos peligros, por lo que se ha generado un nuevo modelo ético que se integre al proceso de atención de enfermería. Con el objetivo de determinar los conocimientos y opiniones de estos profesionales, del área de cirugía de mínimo acceso, acerca de la aplicación del modelo en el contexto (...) de estos servicios, se diseñó una investigación de tipo observacional descriptiva con empleo de metodología cualitativa. Como técnica de exploración se usó la entrevista en profundidad, así como un panel de expertos para la construcción de la guía de entrevista. Se entrevistó a 34 enfermeras que laboraban en el Centro Nacional de Cirugía de Mínimo Acceso durante el período del estudio. Se concluye que la práctica de la cirugía de mínimo acceso es propicia para que médicos y enfermeras hagan una mayor observancia del derecho de autonomía de los pacientes. Se reconoce la capacidad de este personal para tomar decisiones independientes de los médicos en cuanto a las acciones de cuidado, lo que implica una mayor responsabilidad. Scientific and technological advances have opened a gap between medical treatments and the moral values that should support health care. The nurse is not exempt from these dangers. As such, a new ethical model that integrates to the process of nursing care has emerged. In order to determine the knowledge and opinions of the professionals who work in minimal access surgery services on the implementation of this model, a descriptive, observational study was designed utilizing qualitative methodology. In-depth interviewing was used as the primary testing technique. A panel of experts from the National Center of Minimal Access Surgery was consulted to develop the interview guide. Thirty-four nurses from the National Center for Minimal Access Surgery were interviewed over the course of the study period. Results suggest that the setting of minimal access surgery is conducive to medical professionals making greater observance of the right to patient autonomy. The ability of this staff to make independent decisions regarding medical care action is recognized, which implies greater responsibility. (shrink)

RODRÍGUEZ LLAMOSÍ, Juan Ramón: Casos difíciles de conciencia judicial.

Los Anales de la Cátedra Francisco Suárez se han ganado a pulso, a lo largo de los años, sobre todo gracias a la tenacidad de Nicolás López Calera y al equipo formado en torno a él en la Facultad de Derecho de Granada, el mérito de ser la principal referencia bibliográfica de la Filosofía del Derecho en España junto al Anuario de Filosofía del Derecho en la etapa en que J. J. Gil Cremades fue su director. Otras revistas se (...) han ocupado menos del filosofar jurídico que, fundamentalmente, de lo que podríamos llamar problemas de teoría general y de interpretación del derecho. Y ahora, por la amistosa pero tenaz compulsión de M. Saavedra, me veo en la obligación de contribuir a esta entrega de una revista prestigiosa, con no poca vergüenza, con la descripción de mi más que modesta aportación a la reflexión jurídico-política en los últimos casi cincuenta años. Las páginas que siguen expresarán pues una autopercepción, que sin duda deberá ser corregida por el lector. No obstante, trataré de introducir datos que puedan rectificar lo que me parecen errores de algunas publicaciones sobre la filosofía del derecho española en general y sobre mi propio trabajo en particular. ABSTRACT This article examines how Robert Owen’s ideas, and the example of his New Lanark Mill, were understood and received in Spain in the nineteenth century. It follows recent historiographic trends in the history of early Spanish socialism to show that although Owen’s ideas could not have a decisive impact in a largely agricultural economy and society, his ideas did draw more significant attention that has been thought. The article examines how Owen’s ideas, like those of Fourier and Saint-Simon, were (...) transmitted in Spain through different channels, in particular in education through the work of Pablo Montesino, and in the 1850s and 60s how they proved important to the creation of workers’ co-operatives in Valencia and Madrid. The article also explores how Owen’s ideas were important to the influential Spanish author Ramón de Sagra, and shows that the epistolary relationship between the two suggests that de Sagra might have been a more important voice for Owen’s ideas in Spain than has been appreciated. In the recent literature on contextualism and relativism, one often finds disputes as to which kind of consideration would be relevant for positing a feature of a context as a parameter in the ‘‘circumstance of evaluation’: via the presence of an operator in the language which shifts that feature (Stanley) or by being a feature of a context with respect to which the truth of ‘‘propositions’’ expressed in the context is relative (McFarlane). This kind of dispute arises from two different (...) independent roles that elements in ‘‘circumstances of evaluation’’ are sometimes assumed to have. I distinguish indices from points of evaluation, and motivate its significance in the debate. (shrink)

This chapter defends a version of the indexical contextualist form of moderate relativism: the attempt to endorse appearances of faultless disagreement within the framework in which a sentence at a context at the index of the context determines its appropriate truth-value. Many object that any such an indexical proposal would fail to account for intuitions of (genuine) disagreement as revealed in ordinary disputes in the domain. The defence from this objection exploits presuppositions of commonality to the effect that the addressee (...) is relevantly like the speaker of the context. (shrink)

A presente proposta tem como seu principal objetivo mostrar como a emergência de hábitos autocontrolados de emoções podem ser explicados segundo a gramática especulativa de Peirce. Como resultado, espero mostrar, uma possível aplicação da gramática especulativa, sobre o qual muito é especulado, mas pouco é aplicado; segundo, sugerir uma possível teoria da linguagem entendida como uma forma controlada de nossos sentimentos de tal modo a permitir que sejam compartilhadas e comunicadas. Além disso, e ainda mais importante, isto mostraria que a (...) divisão tradicional entre a faculdade da razão e a faculdade emocional não é tal, antes deve ser dito que a razão, ou melhor a razoabilidade, surge e afunda suas raízes nessa faculdade e cresce dela em um continuum. Assim, qualquer educação que vise o autocontrole deve começar com uma educação estética ou, se preferir, com uma educação sentimental. (shrink)

What different relativist claims about a given domain are to be distinguished? Which of them is best placed to account for intuitive facts about disagreement in that domain? In a recent paper in this journal, ‘Indexical Relativism versus Genuine Relativism’ (2004), Max Kölbel distinguishes two forms of relativism, andargues that one of them, indexical relativism, faces problems in accounting for disagreement. In the first part of this discussion I present my own taxonomy of relativist positions in a given domain, which (...) is based on David Lewis’s 1980 essay, and I compare it with Kölbel’s and other recent suggestions. In the second part, I argue that the presuppositional defence of indexical relativism against related objections that I have elaborated elsewhere is also effective against Kölbel’s recent charges. Consider a cat on a mat. On the one hand, there seems to be just one cat, but on the other there seem to be many things with as good a claim as anything in the vicinity to being a cat. Hence, the problem of the many. In his ‘Many, but Almost One,’ David Lewis offered two solutions. According to the first, only one of the many is indeed a cat, although it is indeterminate exactly which one. According to the (...) second, the many are all cats, but they are almost identical to each other, and hence they are almost one. For Lewis, the two solutions do not compete with each other but are mutually complementary, as each one can assist the other. This paper has two aims: to give some reasons against the first of these two solutions, but then to defend the second as a self-standing solution from Lewis’s considerations to the contrary. Peirce escribió pocas líneas sobre la función normativa de la ciencia de la ética y de su papel en la filosofía en general, de ahí la necesidad de reconstruir y complementar el vínculo de este saber teorético con la reacción entre fenómenos según unos fines de acción (...) determinados. There are certain metaphysically interesting arguments ‘from vagueness’, for unrestricted mereological composition and for four-dimensionalism, which involve a claim to the effect that idioms for unrestricted quantification are precise. An elaboration of Lewis’ argument for this claim, which assumes the view of vagueness as semantic indecision, is presented. It is argued that the argument also works according to other views on the nature of vagueness, which also require for an expression to be vague that there are different admissible alternatives of (...) the relevant sort, such as epistemicism, as defended by Williamson. Recent attempts to resist the argument are discussed and rejected. (shrink)

In recent years, some people have held that a radical relativist position is defensible in some philosophically interesting cases, including future contingents, predicates of personal taste, evaluative predicates in general, epistemic modals, and knowledge attributions. The position is frequently characterized as denying that utterance-truth is absolute. I argue that this characterization is inappropriate, as it requires a metaphysical substantive contention with which moderate views as such need not be committed. Before this, I also offer a more basic, admittedly less exciting (...) alternative characterization of the position, in terms of departing from the Kaplan–Lewis–Stalnaker two-dimensional framework. In recent discussions on contextualism and relativism, some have suggested that audience-sensitivity motivates a content relativist version of radical relativism, according to which a sentence as said at a context can have different contents with respect to the different perspectives from where it is assessed. The first aim of this note is to illustrate how this is not so. According to Egan himself, the phenomenon motivates at least refinement of the characteristic moderate contention that features of a single context determine (...) the appropriate truth-value of the sentence. We say that each social group is identical to its members. The group just is them; they just are the group. This view of groups as pluralities has tended to be swiftly rejected by social metaphysicians, if considered at all, mainly on the basis of two objections. First, it is argued that groups can change in membership, while pluralities cannot. Second, it is argued that different groups can have exactly the same members, while different pluralities cannot. We rebut these objections, (...) and argue that our plural view is superior to alternative reductive proposals which would identify social groups with the sets or fusions of their members. Finally we deal with some further potential challenges for the view of groups as pluralities. Thus we aim to establish it as a serious contender in the metaphysics of groups. (shrink)

What are things like the Supreme Court? Gabriel Uzquiano has defended that they are groups, entities which are somehow composed of members (at certain times) but which, unlike sets (or pluralities), allow for fluctuation in membership. The main alternative holds that 'the Supreme Court' refers (at any time) to the set (or plurality) of their members (at the time). Uzquiano motivates his view by posing a metaphysical puzzle for this reductive alternative. I argue that a parallel reasoning would also find (...) a corresponding 'puzzle' in the case of singular terms like 'The Chief Supreme Court Justice'. (shrink)

Some philosophers seem to think that borderline cases provide further cases of apparent faultless disagreement. My aim here is to argue against such a suggestion. I claim that with respect to borderline cases, people typically do not respond by taking a view—unlike what is the case in genuine cases of apparent faultless disagreement. I argue that my claim is indeed respected and actually accounted for by paradigm cases of semantic and epistemic views on the nature of vagueness. And I also (...) argue that my claim turns out to be, initial appearances notwithstanding, compatible with other claims in the literature—to the effect that, in appropriate circumstances, there are indeed, or there might well be, “macho,” admissible, forced, and hesitant responses to borderline cases. This paper is in five sections. In the first one, I summarize some views on truthmaking I will be presupposing, emphasizing however the various controversies on which I will remain neutral. In section two and three, I present the characterization of a response-dependent property. In section four, I present two ways in which a property can be response-dependent, in the characterized sense. In final section five, I present how these correspond to different versions of moderate relativism, namely indexical and nonindexical (...) contextualism. Thus the view presented here contrasts not only with pluralism about truth, but also with radical relativism about truth, as recently defended by John MacFarlane. (shrink)

Timothy Williamson famously offered an argument from these Tarskian principles in favor of bivalence. I show, dwelling on (Andjelkovic & Williamson, 2000), that the argument depends on a contentious formulation of the Tarskian principles about truth (and falsity), which the supervaluationist can reject without jeopardizing the Tarskian insight. In the mentioned paper, Adjelkovic and Williamson argue that, even if the appropriate formulation seems to make room for failure of bivalence in borderline cases, this appearance is illusory, once one grants an (...) independent further principle involving biconditionals. I finally argue that the formulation of this is, however, contentious in a similar manner. (shrink)
